租客不还租金,屋主可以这么做?

  如果租客拖欠租金,屋主可以书面方式向租客正式追讨。 如果租期内无法清还,屋主可聘请律师发出律师信通知租客说拖欠逾期租金的总额,并告知如果在一定时间内不还清拖欠的租金,屋主将终止租约,索取双倍租金,没收保证金。 如果租客仍然无动于衷,屋主可及时终止租约及没收保证金。 要是租客在租约终止后不愿搬离有关单位,屋主可入禀法庭申请驱逐令,以便将租客逐出房屋。 业主有两个法令可以维护自己的权益: 当租户拒绝缴付租金和搬离,可依据1950年具体救济法令下(Specific Relief Act 1950)来申请驱逐令(Eviction Order)收回自己房屋。 另外可依据1951年动产扣押法令(Distress Act 1951) 申请财产扣押令(Writ of Distress)来扣押租客的动产。销售所得将作为偿还租客拖欠的租金。 申请庭令后,法庭执行官会与屋主一起到现场。 执行官被授权扣押租户的动产如家私、家电(私人财产除外)并拍卖。 拍卖所得将用作支付租户所欠的租金和一切相关费用。必须注意的是,上述“财产扣押令”只限于追讨最多12个月的租金。 简单的就是说,如果租客还住在你的房子里,你可以: 你跟租客和谈,给租客一个期限,免租,让他们自愿搬出; 请律师赶租客,合法的赶他们出去。请律师需要花好几千块甚至过万,又耗时。所以欠好几万的租金,才请律师。 简单的就是说,如果租客已经搬走了,但是欠你租金、水电费或者维修费/装修费(他们弄坏了房子里的家具),你可以: 如果欠的数额超过30千以上(我个人认为,这样的数额才值得请律师处理),你可以请律师入禀法庭。法庭手续请看: 马来西亚民事诉讼程序  如果欠的数额少过5千,你可以自己DIY的在小额索赔法庭提告租客。手续请按: 。小额索赔法庭 Small Claim Court。 如果数额超过5千,就算你最后只是拿到5千,但还是便宜过请律师,你也是可以在小额索赔法庭提告租客。
